- Indemnification

You agree to indemnify, defend, and hold harmless MyBench, its affiliates, officers, directors, employees, agents, and contractors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

– Any bench construction or related activities you undertake;
– Your violation of these Terms and Conditions or any applicable law or regulation; and
– Any injury or damage to any person or property arising from your bench-building activities.
2.2 Waiver of Claims:
By using our Services, you expressly waive any and all claims you may have, now or in the future, arising out of or related to your use of the Services or any bench-building activities you undertake.
- Assumption of Risk
3.1 Voluntary Participation:
You acknowledge that bench construction and related activities involve inherent risks, including but not limited to the risk of physical injury, property damage, and legal liability. You voluntarily assume all risks associated with these activities, and you agree that we are not responsible for any injuries, damages, or other losses that may occur as a result of your participation.
- Limitations of Liability
4.1 No Consequential Damages:
To the maximum extent permitted by applicable law, in no event shall MyBench be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, loss of data, or loss of goodwill, arising out of or related to your use of the Services or any bench-building activities you undertake, even if we have been advised of the possibility of such damages.
4.2 Cap on Liability:
Our total liability to you for any and all claims arising out of or related to these Terms and Conditions or your use of the Services, whether in contract, tort, or otherwise, shall not exceed the amount you have paid to us, if any, for the use of the Services.
- User Conduct and Responsibilities
5.1 Compliance with Laws:
You agree to comply with all applicable local, state, and federal laws, regulations, and ordinances in connection with your use of the Services and any bench-building activities you undertake.
5.2 Respect for Property:
You are responsible for obtaining all necessary permissions and permits before constructing a bench on any property, whether public or private. You agree to respect the rights of property owners and to avoid constructing benches in locations where doing so may violate the law or infringe on the rights of others.

All content provided through our Services, including but not limited to text, graphics, logos, images, and software, is the property of MyBench or its content suppliers and is protected by copyright, trademark, and other intellectual property laws. 6.2 Your Contributions:
If you submit any content or ideas to us, including but not limited to photos, videos, or descriptions of your bench-building projects (“User Content”), you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, distribute, and display such User Content in any media or format.

We reserve the right to terminate or suspend your access to the Services at any time, without notice, for any reason, including but not limited to your violation of these Terms and Conditions.

These Terms and Conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which MyBench is headquartered, without regard to its conflict of law principles.
